1031 Exchange Help for North Texas Commercial Real Estate Investors
Selling an investment property and planning your next one? Barb Cole helps you search for replacement property across Dallas, Collin and Denton counties, Frisco and surrounding areas.
What is a 1031 exchange?
A 1031 exchange, named for Section 1031 of the Internal Revenue Code, lets an investor sell real property held for investment or business use and reinvest the proceeds in other like-kind real property. When the rules are followed, federal capital gains tax on the sale can be deferred rather than due at closing. It is a deferral tool with strict rules and deadlines. Whether an exchange fits your situation is a question for your tax or legal advisor.
The timeline most investors hear about first
45 days: after you close the sale of your original property, you generally have 45 days to identify potential replacement properties in writing.
180 days: you generally must close on the replacement property within 180 days of the sale, or by the due date of your tax return for that year, whichever comes first.
These clocks run at the same time and are not extended for weekends or holidays. Starting the replacement search before you sell gives you more room.
Who an exchange may fit
Owners of office, retail, industrial, multifamily, land or mixed-use property held for investment. Investors who want to change markets, property types or management load while keeping their capital invested. Owners selling in North Texas who want to reinvest in North Texas or elsewhere.
How Barb helps
Understanding your goals: the kind of property, the market, the price range and the timing you are working to.
Searching for replacement properties: finding and reviewing commercial listings and off-market leads that match your criteria, so you have options inside the 45-day window.
Working with your team: coordinating with your qualified intermediary and your tax or legal advisor so the real estate side stays in step with the exchange paperwork.
Negotiating and closing: representing you as buyer on the replacement property and keeping the 180-day deadline in view.
Property types Barb covers
Retail, office, industrial, multifamily, land, mixed-use and special-use property across North Texas.
Work with the right professionals
A 1031 exchange requires a qualified intermediary, a neutral third party who holds the sale proceeds between closings. You generally cannot take possession of the proceeds yourself without putting the exchange at risk. Barb is a real estate broker, not a tax advisor, attorney or intermediary. Please talk to your own qualified intermediary and tax or legal advisor before you sell.
